This Privacy Policy is published by 1000961632 Ontario Inc. o/a ProOps Consulting, an Ontario corporation ("ProOps Consulting," "we," "us," or "our"), and governs the collection, use, and protection of personal information by our consulting services, our corporate website (www.proopsconsulting.ca), and our general business operations.

We are based in Toronto, Ontario, Canada, and operate under applicable Canadian federal and provincial privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, Quebec's Act Respecting the Protection of Personal Information in the Private Sector (Law 25). We are committed to protecting your privacy and ensuring transparency in how we handle your data.

This Policy covers our consulting services, website, and general business operations. Data handling for the ProOps Ads Tracker product (including Ads Tracker HQ, the Chrome Extension, and the Troubleshoot Assistant) is governed by the separate ProOps Ads Tracker Privacy Policy, which takes precedence over this Policy with respect to the Ads Tracker product.

By using ProOps Consulting services or our website, you agree to this Privacy Policy. For ProOps Ads Tracker specifically, you also agree to the ProOps Ads Tracker Privacy Policy and the ProOps Ads Tracker Services Agreement. If you do not agree, please do not use our services.

1. Who We Are

  • ProOps Consulting: An ad operations and advisory consulting service based in Toronto, Ontario, Canada, providing strategic recommendations, process design, and operational improvement services to publishers, retail media networks, and in-house digital media teams.

  • ProOps Ads Tracker: Our ad operations monitoring product, comprising Ads Tracker HQ (the cloud-based platform), the Chrome Extension (the primary user interface), and the Troubleshoot Assistant (the opt-in AI feature). Detailed data-handling practices for ProOps Ads Tracker are governed by the ProOps Ads Tracker Privacy Policy, which takes precedence over this Policy with respect to the Ads Tracker product.

We are the legal entity 1000961632 Ontario Inc. operating under the registered business name ProOps Consulting.

2. What Data We Collect

We collect personal information (as defined under PIPEDA as "information about an identifiable individual") only when necessary, with your consent or as required for our services.

2.1. Personal Information You Provide

  • Contact Information: Name, email address, phone number, and company name, when provided through our website, contact forms, or support requests, with express consent.

  • Consulting Engagement Information: Information you share in the course of a consulting engagement, including business documents, project specifications, and meeting notes, used solely for the purpose of delivering the engaged services.

  • Consulting Billing Information: Billing details for ProOps Consulting services, processed securely via our third-party payment processor, Wise (https://wise.com/privacy). We do not store full payment card or bank-account details directly; Wise handles payment processing under its own security standards. Ads Tracker subscription billing is processed separately via Stripe — see the ProOps Ads Tracker Privacy Policy for details.

2.2. Data Collected Automatically

  • Website Analytics: Cookies, IP address, browser type, referral source, and page-view data collected via our website (www.proopsconsulting.ca) to enhance user experience and understand site usage. Non-essential cookies are subject to consent; you can manage preferences through your browser settings.

  • Security Logs: Minimal device and connection information (e.g., IP address, timestamp) collected for fraud prevention and security purposes, retained only as long as necessary for those purposes.

2.3. Data from Third Parties

  • Website Analytics Providers: We may use third-party analytics tools (e.g., Google Analytics, Squarespace built-in analytics) to understand website performance, with consent and opt-out options where required by law.

  • Marketing Platforms: Where you have provided consent (e.g., by subscribing to a newsletter or downloading content), we may receive contact and engagement data from third-party marketing platforms.

3. How We Use Your Data

We use your data with your consent or as necessary for our services:

  • Provide and Improve Consulting Services: Deliver ProOps Consulting recommendations, project deliverables, advisory services, and ongoing client support.

  • Website Operation and Analytics: Operate, maintain, and improve our corporate website (www.proopsconsulting.ca), including measuring page performance and understanding visitor interests.

  • Billing and Account Management: Process consulting invoices via Wise, manage client accounts, and respond to billing inquiries.

  • Security and Compliance: Detect fraud, ensure security of our systems, and comply with Canadian laws including PIPEDA and Quebec's Law 25.

  • Client Communication: Send engagement updates, project communications, support notifications, and other communications relating to active consulting engagements.

  • Marketing (with Consent): Send promotional materials about ProOps Consulting services, including newsletters and content updates. You can withdraw consent at any time via unsubscribe links or by contacting privacy@proopsconsulting.ca.

4. How We Share Your Data

We do not sell personal information. We may share data as follows, in compliance with PIPEDA:

  • Service Providers: Third-party vendors who help us operate our consulting business and website, including Squarespace (website hosting), Wise (consulting payment processing), and Google Workspace (email, document management, and collaboration). These providers are subject to data-processing agreements with PIPEDA-equivalent protections.

  • Legal Requirements: If required by Canadian law (e.g., court orders, regulatory requests), with notification to you unless prohibited by law.

  • Business Transfers: In the event of a merger, acquisition, asset sale, or similar business transaction, your personal information may be transferred to the successor entity. We will provide prior notice as required under PIPEDA.

  • With Your Consent: For any additional sharing or integrations beyond what is described in this Policy, with your clear and specific consent.

5. Data Security

We implement reasonable security measures, as required by PIPEDA:

  • Encryption of data in transit and at rest using TLS and AES-256 industry-standard encryption.

  • Access controls limiting data access to authorized personnel only, on a need-to-know basis.

  • Secure credential management for systems handling client data.

  • Use of vendor platforms (Squarespace, Wise, Google Workspace) that maintain their own security certifications and controls.

In the event of a data breach affecting personal information, we will notify affected individuals within seventy-two (72) hours of discovery, as required by PIPEDA, and provide details of the breach, the data affected, and remediation steps taken.

6. Data Retention

We retain personal information only for as long as necessary to provide our services, fulfill legitimate business purposes, and comply with legal obligations:

  • Consulting Clients: We retain client records, project documentation, communications, and billing information for a minimum of six (6) years following the end of the engagement, as required by Canadian record-keeping standards and to support potential follow-on work.

  • Website Visitors: Website analytics data and contact form submissions are retained for up to twenty-four (24) months, unless you request earlier deletion.

  • Marketing Contacts: Marketing contact data is retained until you withdraw consent (e.g., via an unsubscribe link or by contacting privacy@proopsconsulting.ca).

  • Ads Tracker Subscribers: See the ProOps Ads Tracker Privacy Policy, Section 6, for retention practices specific to the Ads Tracker product.

On request, we will delete personal information sooner where required by applicable law or where retention is no longer necessary. Aggregated, anonymized data may be retained indefinitely for business improvement purposes.

7. Your Rights

Under PIPEDA and (where applicable) Quebec's Law 25, you have the following rights:

  • Access: Request a copy of the personal information we hold about you.

  • Correction: Update or correct inaccurate personal information.

  • Deletion: Request deletion of your personal information, subject to legal retention requirements (see Section 6).

  • Withdrawal of Consent: Revoke consent for ongoing data processing by emailing privacy@proopsconsulting.ca.

  • Challenge Compliance: File a privacy complaint with us via privacy@proopsconsulting.ca, with the Office of the Privacy Commissioner of Canada (www.priv.gc.ca), or (for Quebec residents) with the Commission d'accès à l'information du Québec (www.cai.gouv.qc.ca).

8. International Data Transfers

Some service providers used by ProOps Consulting (e.g., Google Workspace, Wise, Squarespace) may process and store data on infrastructure located in the United States and other jurisdictions outside Canada. We rely on each vendor's data-processing agreements, security certifications, and contractual safeguards to ensure data is handled with PIPEDA-equivalent protections.

9. Children's Privacy

ProOps Consulting services and our website are not directed to children. We do not knowingly collect personal information from children under thirteen (13) years of age, or under sixteen (16) in Quebec. If we become aware that we have collected such data, we will delete it promptly and notify parents or guardians where required by PIPEDA. 10. Privacy Rights for Visitors and Clients Outside Canada

While ProOps Consulting operates from Canada and is primarily subject to PIPEDA and Quebec's Law 25, individuals in other jurisdictions may have additional privacy rights:

  • California (CCPA/CPRA): Right to know, delete, correct, opt out of sale (we do not sell personal information), and limit the use of sensitive personal information.

  • EU/UK (GDPR/UK GDPR): Right of access, rectification, erasure, restriction of processing, data portability, and objection. We rely on legitimate interests and consent as legal bases for processing.

  • Other jurisdictions: Where local data protection laws provide greater rights than PIPEDA, we will honor those rights to the extent applicable.

11. Changes to This Policy

ProOps Consulting may modify this Privacy Policy from time to time by posting an updated version on our website. We will provide reasonable notice of material changes (which may be by email to active clients, by website notification, or both) at least thirty (30) days before such material changes take effect.

For changes requiring express consent under PIPEDA (e.g., new categories of personal data collection, new third-party data-sharing arrangements), we will obtain such consent before the change applies to your data.

Continued use of our services after the effective date of non-material changes constitutes acceptance of the modified Policy.
